By accessing or using Lead Trustify's B2B lead verification platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Lead Trustify provides B2B lead verification services including email validation, phone number verification, job title verification, company data enrichment, suppression list checking, and LinkedIn profile matching. Our Service helps businesses ensure the accuracy and deliverability of their lead data.

3. Account Registration

To use our Service, you must:

• Be at least 18 years old
• Register for an account with accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Use a valid business email address for registration

4. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Send unsolicited commercial communications (spam)
• Harvest or collect email addresses for spam purposes
• Upload malicious content or attempt to compromise our systems
• Resell or redistribute our verification data without authorization
• Abuse our API or exceed rate limits intentionally
• Verify leads for illegal or unethical purposes

5. Credits and Billing

Our Service operates on a credit-based system:

• Credits are consumed for each lead verification request
• Unused credits expire 12 months from the date of purchase
• Credits are non-refundable unless otherwise specified
• New accounts receive 100 free credits for evaluation
• Pricing and credit packages may change with 30 days' notice

6. Data Ownership

You retain all ownership rights to the lead data you upload to our Service. We do not claim ownership of your data. However, you grant us a limited license to process, store, and analyze your data solely for the purpose of providing the verification Service. We may use aggregated, anonymized data for improving our services and generating industry insights.

7. Service Availability

We strive to maintain 99.9% uptime for our Service. However, we do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will provide reasonable advance notice of scheduled maintenance when possible.

8. Accuracy Disclaimer

While we strive for the highest accuracy in our verification results, we cannot guarantee 100% accuracy. Our verification results are based on data available at the time of processing and may change over time. You acknowledge that verification results should be used as one factor in your lead evaluation process.

9. Limitation of Liability

To the maximum extent permitted by law, Lead Trustify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Lead Trustify and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time through your account settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in San Francisco, California.
