Dialer Terms & Calling Policy

1. Overview

Lead Trustify's built-in web dialer is powered by Telnyx and provisions a dedicated Toll-Free and Local phone number per workspace. Upon activating the dialer, you enter into these Calling-Specific Terms in addition to our main Terms of Service. These terms exist to protect the Lead Trustify telephony infrastructure, other users on the platform, and the general public from telecom abuse.

2. By Activating the Dialer, You Agree To

The following obligations are mandatory. Non-compliance may result in account suspension or permanent termination without refund.

1. 1. TCPA & Telemarketing Compliance

   You are solely responsible for complying with the Telephone Consumer Protection Act (TCPA) and all applicable local telemarketing laws. You confirm you have prior express written consent from every lead you contact using the Lead Trustify dialer.

2. 2. Prohibited SMS Content

   Your assigned Toll-Free number cannot be used for outbound SMS. Your Local number must not be used to send SMS spam, phishing links, adult content, or highly regulated materials including but not limited to CBD, firearms, payday loans, or debt collection.

3. 3. Caller ID Integrity — No Spoofing

   You are restricted to dialing exclusively from the two Caller IDs (Toll-Free and Local) assigned to your specific workspace by Lead Trustify. Caller ID spoofing or impersonation of any other number is strictly prohibited.

4. 4. Traffic Monitoring & Account Review

   You consent to Lead Trustify monitoring your overall call volume, answer ratios, and call durations. Irregular traffic patterns — such as hundreds of calls lasting under 3 seconds — will automatically pause your dialer access pending a mandatory manual administrative review.

5. 5. No Refund on Permanent Ban

   If your account is permanently banned following an administrative review for scamming, fraudulent activities, or severe spam complaints, you forfeit access to your assigned telephony numbers and any remaining calling credits without a refund.

6. 6. KYC & Carrier Liability

   Lead Trustify provisions numbers uniquely to your account identity. In the event of severe legal complaints or telecom carrier tracebacks attributed to your traffic, Lead Trustify reserves the right to export your KYC (Know Your Customer) data and associate it directly with your activity at the telecom provider level.

7. 7. Voicemail Recording Consent

   The voicemail feature records incoming caller messages and stores them securely on your behalf. Callers are informed their message is being recorded. You must comply with all applicable recording consent laws in your jurisdiction and those of your callers.

8. 8. Usage Monitoring & Transparency

   You consent to Lead Trustify tracking and displaying your dialer usage statistics — including call duration, frequency, SMS volume, and credit consumption — in your Dialer Dashboard for transparency and ongoing compliance monitoring.

3. What the Dialer Provides

• Zero-configuration number provisioning — no need to set up an LLC, Telnyx account, or A2P 10DLC registration separately
• Dedicated Toll-Free number for inbound calls and a Local number for high-conversion outbound calls — numbers are permanently yours while your account is active and are never shared with other users
• Automated IVR that answers your Toll-Free calls with your company name, manages hold states, and records voicemails
• Voicemail inbox with audio playback, AI transcription, read/unread status, and outbound voicemail drop
• Full Dialer Dashboard with call history, usage analytics, number management, and SMS threads — completely independent from the Lead Verification system

4. Limitations & Warnings

• Strict spam penalties: Because you operate under the Lead Trustify telephony umbrella, we have zero tolerance for aggressive cold-calling without consent. High carrier blockage rates will flag your account for manual review and potential suspension.
• Number burnout: If your Local number is flagged by major carriers (AT&T, Verizon, T-Mobile) due to excessive spam complaints, outbound calls may display as "Spam Likely." Burned numbers caused by poor calling practices are not freely replaced — an administrative fee applies.
• SMS channel restriction: You cannot send SMS from your Toll-Free number. All outbound text messages must route through your designated Local number.
